Privacy and Personal Data Protection Notice
This notice is provided, in compliance with Art. 4 of Law No. 1.565 of 12/03/2024 (see also Arts. 13 and 14 of EU Regulation 679/2016 or G.D.P.R.) (hereinafter the “Law”), to users (hereinafter: “Users” or “User”) of the desktop and mobile version of the website https://www.montecarlo-realestate.com/it (hereinafter: the “Site” or “Montecarlo Real Estate”), owned by ImmoSoft.SARL, the Controller of personal data processing (hereinafter: the “Controller”). The purpose of this document is to describe how the Site is managed with respect to personal data processing and to allow Users of the Site to become aware of the purposes and methods of processing personal data by the Controller in the event they provide such data.
Controller of the Data Processing and Data Protection Officer

As specified in the General Terms and Conditions of Service, the services offered by the Controller are intended for persons over 18 years of age. Should the Controller become aware of any processing of personal data belonging to minors under 18 years of age without valid consent from parents or a legal guardian, it reserves the right to unilaterally discontinue the provision of the offered service and to erase the data obtained.
Any terms not defined in this Privacy Notice have the same meaning described in the General Terms and Conditions of Service.
Users who publish real estate listings undertake to comply with the General Terms and Conditions of Service, also with respect to personal data protection. Users assume responsibility for any communication and publication of third-party data, guaranteeing that they have full right to disclose such data. The Controller disclaims any liability towards third parties arising from any unlawful use of their data.
This notice is provided solely for the Immosoft.mc Site and does not refer to other websites accessible by the User through any links that may be present on the Site.
1. Principles Applicable to Personal Data Processing
The Controller informs data subjects that the processing is based on compliance with the principles of fairness, lawfulness, transparency, and the protection of confidentiality and fundamental rights.

2. Subject of the Processing
Below are the categories of User data that may be processed by the Controller:
Personal data automatically acquired when visiting the Site:
- Browsing data.The Controller automatically collects data about the device (PC, tablet, mobile phone, or other mobile device) and the connection used by the User, including, for example, the IP address, the date and time of access, information about hardware and software, information about device-related events, and data on any crashes.
- Data on Site usage.The Controller collects information about how the User uses the Site, including, for example, the pages and content viewed, searches performed, and links to third-party websites and applications on which the User has clicked.
Personal data provided directly by the User:
- In order to provide certain services, for example saving searches, favorite properties, and prices, the User must register on the Site by clicking the “Accedi” button in the “Non hai ancora un account? Registrati” section. Registration can be done via Google, via Apple, or by e-mail.
The data required for Registration are limited to:
- First name
- Last name
- E-mail address
- Telephone number
These data are obtained directly from the User via the form or by linking an existing Google or Apple account.
- By accessing their personal section on the Site (hereinafter the “User Profile”), the User can provide additional personal data, as optional information (e.g., date of birth, gender, residence), which will be collected by the Controller if provided.
Optional data:
- Data provided by requesting information via e-mail.If the User sends an e-mail to Montecarlo Real Estate’s addresses listed on the Site, or uses the form available under “Contatti” in the “Contatti” section in order to request information, Montecarlo Real Estate acquires the e-mail address and any personal data of the User (and/or third parties) included in the text of the electronic communication, as well as – for the “Contatti” form – the name, the company name, the e-mail address, the telephone number, and any personal data of the User (and/or third parties) included in the text of the message.
Personal data collected through cookies:
- Data provided through the use of cookies.The Controller uses cookies to collect data about the User’s activity on the Site and about the User’s preferences, as well as other technical data about the User. For more information on the use of cookies, the User can consult the cookie policy at the following link (*).
3. Purposes and Legal Basis for the Processing
Montecarlo Real Estate processes the User’s personal data in order to:
- Provide, operate, and improve the services that the Controller offers through the Site;
- Operate and improve the Site;
- Keep the services provided by the Controller through the Site secure, protected, and operational.
With regard to these purposes, pursuant to Art. 5(3) of Law No. 1.565 of 12/03/2024 (see also Art. 6(1)(b) G.D.P.R.), the legal basis for the processing is the performance of a contract to which the data subject is party or the performance of pre-contractual measures taken at the data subject’s request.
Furthermore, Montecarlo Real Estate processes the User’s personal data for the following purposes:
- Prevent, detect, and mitigate security breaches and potentially prohibited or illegal activities;
- Resolve disputes arising with the User;
- Identify and address problems encountered by the User in using the Site (for example, blocked or non-functional pages) and provide a better experience;
- Collect aggregated statistical information on the number of Users visiting the Site and on how they use the Site;
- Send communications regarding any service disruptions relating to the services offered.
With regard to these purposes, pursuant to Art. 5(6) of Law No. 1.565 of 12/03/2024 (see also Art. 6(1)(f) G.D.P.R.), the legal basis for the processing is the pursuit of the Controller’s (or third parties’) legitimate interests, in compliance with the interests or fundamental rights and freedoms of the data subject.
4. Methods of Processing and Retention of Personal Data
The Controller ensures that personal data is processed in full compliance with Law No. 1.565 of 12/03/2024 and with the applicable legislation in the Principality of Monaco (and with the G.D.P.R. where applicable), by means of manual, IT, or digital systems.
Processing is carried out through automated tools that store, manage, and transmit the data in question.
The data collected is protected by physical and logical methods that minimize the risk of unauthorized access, disclosure, loss, and destruction, pursuant to Law No. 1.565 of 12/03/2024 (see also Arts. 25 and 32 G.D.P.R.).
The data processing will not last longer than necessary to fulfill the purposes for which the data was collected.
If the Controller does not receive a request for erasure, personal data will be stored for no more than ten (10) years from the date of the User’s last access to the Site.
The User’s personal data may be retained for longer periods if this is necessary to fulfill legal obligations of the Controller or to protect a right in court.
At the end of these retention periods, the User’s data will be erased or permanently anonymized.
5. Recipients of Personal Data
The personal data collected may be processed by individuals or categories of individuals who act, pursuant to Art. 26 of Law No. 1.565 of 12/03/2024 (see also Art. 28 G.D.P.R.), as data processors or, pursuant to Law No. 1.565 of 12/03/2024, as persons authorized to process data (see also Art. 29 G.D.P.R.).
Montecarlo Real Estate may transfer the Customer’s personal data to a party acting as a processor under Art. 26 of Law No. 1.565 of 12/03/2024 (see also Art. 28 G.D.P.R.) to conduct activities investigating the Customer’s level of satisfaction.
Aside from the foregoing, personal data will not be disclosed except to entities, bodies, and authorities to which disclosure is mandatory by virtue of statutory or regulatory provisions. Specifically, data may be disclosed to comply with obligations under anti-money laundering regulations.
6. Transfer of Data to a Third Country or an International Organization
The personal data collected through the Site may be transferred outside of the national territory solely and exclusively for the performance of the services requested through the Site, to provide the most appropriate responses to the requests made, or to improve the services offered. Any data transfer will fully comply with Law No. 1.565 of 12/03/2024 and internal regulations (see also Regulation (EU) 679/2016).
7. Rights of the Data Subject
At any time, the User has the right to request:
- Confirmation as to whether or not personal data concerning them exists, even if not yet recorded, in a concise, transparent, intelligible, and easily accessible form, using clear and plain language;
- An indication of:

- The origin of the personal data;
- The purposes and methods of processing;
- The legitimate interests pursued by the Controller or by third parties;
- Any recipients or any categories of recipients of the personal data;
- The Controller’s possible intention to transfer personal data to a third country or to an international organization;
- The retention period of the personal data;
- The logic applied, as well as the significance and the envisaged consequences of such processing for the data subject, in the case of processing carried out by electronic means in the context of an automated collection and/or profiling process;
- The identifying details of the Controller, the Processors, the possible Designated Representative, and the Data Protection Officer (DPO);
- The individuals and categories of individuals to whom personal data may be disclosed or who may become aware of it in their capacity as the designated representative in the State’s territory, or as processors or persons in charge of processing.
- The possibility of lodging a complaint with a supervisory authority;
- The updating, rectification, or, where interested, integration of the data;
- The erasure, transformation into anonymous form, or blocking of data processed in breach of the law, including data the retention of which is not necessary in relation to the purposes for which the data was collected or subsequently processed;
- The restriction of processing;
- The portability of personal data concerning them to another data controller;
- Withdrawal of consent to processing;
- Objection, in whole or in part, on legitimate grounds, to the processing of personal data concerning them, even if it is pertinent to the purpose of the collection.
To exercise these rights, the data subject may contact the Controller at any time by submitting a written request – without formalities – to the following address: 36 Avenue De L’Annonciade, Local, B03.02 Tour Odeon, 98000 Monaco;
The Controller will respond to the User’s requests within one month of receipt. In view of the complexity and number of requests received by the Controller, this deadline may be extended by two months. In that case, within one month of receipt of the request, the Controller will inform the User of the extension and the related reasons.
If the response is not considered satisfactory, the User may lodge a complaint with the competent Data Protection Authority pursuant to Art. 38 of Law No. 1.565 of 12/03/2024.
8. Social Buttons
The Site uses various links that allow Users to visit the Facebook, Twitter, Instagram, and Pinterest profiles of Montecarlo Real Estate (see the Site footer). These links – which appear as icons of the respective social networks – do not result in the installation of third-party cookies.
9. Changes
This notice may be subject to change. If Montecarlo Real Estates makes substantial changes to how it uses the User’s data, it will notify the User by publishing them prominently on its pages.
